If there is any doubt or ambiguity as to whether any User Generated Content constitutes a Submission, such User Generated Content shall be conclusively deemed to be a Submission.
No Submission shall be subject to any obligation of confidentiality on our part, and we shall not be liable for any use or disclosure of any Submission. Without limiting the foregoing, you hereby grant to us (and our licensees, distributors, agents, representatives and other authorised users), without any authorisation or payment required from you or any other person or entity, a perpetual and non-exclusive right , irrevocable, fully paid, royalty-free, sublicensable and transferable worldwide license to use, reuse, reproduce, transmit, print, publish, display, exhibit, distribute, redistribute, copy, host, store, cache , archive, index, categorise, annotate, distribute, broadcast, edit, alter, modify, adapt, translate, create derivative works based on, and publicly perform any or all of these Submissions in any and all media formats and channels now known or hereafter devised (including, but not limited to, on GDC websites and on third party websites) for any purpose, including but not limited to news, publicity, promotion, marketing, advertising, trade or commercial purposes, all without further notice to you and with or wi without attribution (the “Submission Licence”).
To the extent that any Submissions you submit contain original songs or recordings, you hereby represent that you are a member of ASCAP, BMI, SESAC or any other applicable performing rights society and that all musical compositions (including lyrics) contained in such Submissions are provided to us (and our licensees, distributors, agents, representatives and other authorised users) directly by such societies. Notwithstanding the foregoing, and whether or not you are a member of a performing rights society, you hereby grant us (and our licensees, distributors, agents, representatives and other authorised users) a perpetual, non-exclusive and irrevocable licence to publicly perform any and all musical compositions (including lyrics) contained in such Submissions. To the extent that we solicit Submissions through features or activities on the Dublinbetgagner website.com (including but not limited to games, sweepstakes, contests, promotions and public forums (as defined below in Section 6 “PUBLIC FORUMS AND COMMUNICATION”)) that require the use of our copyrighted works (in whole or in part), we hereby grant you a non-exclusive license to create a derivative work using our copyrighted works (in whole or in part); provided, however, that this licence is conditioned on you assigning all rights in the work you create for us (and our licensees, distributors, agents, representatives and other authorised users). If these rights are not assigned to us (and our licensees, distributors, agents, representatives and other authorised users), your licence to create material using our copyrighted works (in whole or in part) is null and void. You agree to the foregoing grant of rights, consents, agreements and assignments whether or not we use your Submissions.
